Ron DeSantis\u2019 team, tweeted that Penny would be \u201cwelcome in Florida.\u201d<\/p>\n<p>He\u2019s welcome in Florida <a href=\"https:\/\/t.co\/7u7qCFAbWt\">https:\/\/t.co\/7u7qCFAbWt<\/a><\/p>\n<p>\u2014 Christina Pushaw   (@ChristinaPushaw) <a href=\"https:\/\/twitter.com\/ChristinaPushaw\/status\/1866171000829735168?ref_src=twsrc%5Etfw\">December 9, 2024<\/a><\/p>\n\n<p>A witness to a deadly incident earlier this month involving a former Marine who put an unruly subway passenger in a chokehold that ultimately resulted in the passenger\u2019s death called the veteran a \u201chero\u201d in the wake of Manhattan District Attorney Alvin Bragg filing charges of second-degree manslaughter.<\/p>\n<p>\u201cHe\u2019s a hero,\u201d <a href=\"https:\/\/gothamist.com\/news\/daniel-penny-charged-with-killing-jordan-neely-is-gaining-prayers-millions-in-donor-dollars-big-names-are-helping\" target=\"_blank\" rel=\"noopener\">said<\/a> the witness, who has lived in New York City for 50 years.<\/p>\n<p>The woman, who self-described as a woman of color, railed at Bragg for filing charges, saying it was wrong of him to do so.<\/p>\n<p>\u201cIt was self-defense, and I believe in my heart that he saved a lot of people that day that could have gotten hurt,\u201d she told the news outlet.<\/p>\n<p>\u201cA legal defense fund established on behalf of Daniel Penny, who has been charged in the chokehold killing of Jordan Neely on a subway car, has swelled to more than $2.67 million in a matter of days,\u201d Gothamist <a href=\"https:\/\/gothamist.com\/news\/daniel-penny-charged-with-killing-jordan-neely-is-gaining-prayers-millions-in-donor-dollars-big-names-are-helping\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>\u201cMore than 54,000 people have donated to the fund set up by Penny\u2019s lawyers on GiveSendGo, which bills itself as the \u201c#1 Free Christian Fundraising Site\u201d and \u201cleading freedom fundraising platform.\u201d Some 40,000 have offered their prayers as well. The fund was created last week by the law firm Raiser &amp; Kenniff, P.C., and the money and prayers have flowed since \u2013 right along with the veneration of Penny by conservative politicians and other voices,\u201d the report stated.<\/p>\n<p>\u201cDonations have ranged from a few dollars to the thousands, including $10,000 from Vivek Ramaswamy, a Republican running for president, $5,000 from the musician Kid Rock and $20,000 from conservative commentator Timothy Pool. Penny, 24, has been arraigned on a second-degree manslaughter charge and has not yet entered a plea. The website does not indicate the origin of the donations, but the size and breadth of the support lay bare the challenge for prosecutors seeking to convict the decorated Marine veteran,\u201d the report added.<\/p>\n<p>The report said that Neely, who had more than 40 arrests and recently served a year in jail for a violent incident, stormed onto the northbound F Train on May 1 and began threatening passengers.<\/p>\n<p>\u201cI\u2019m sitting on a train reading my book, and, all of a sudden, I hear someone spewing this rhetoric. He said, \u2018I don\u2019t care if I have to kill an F, I will. I\u2019ll go to jail, I\u2019ll take a bullet,\u2019\u201d said the woman, who is in her 60s.<\/p>\n<p>Several scared passengers began crowding towards the subway car\u2019s exits.<\/p>\n<p>\u201cI\u2019m looking at where we are in the tube, in the sardine can, and I\u2019m like, \u2018OK, we\u2019re in between stations. There\u2019s nowhere we can go,\u2019\u201d she said. \u201cThe people on that train, we were scared. We were scared for our lives.\u201d<\/p>\n<p>After Neely used the words \u201ckill\u201d and \u201cbullet,\u201d that\u2019s when Daniel Penny stepped in.<\/p>\n<p>\u201cWhy in the world would you take a bullet? Why? You don\u2019t take a bullet because you\u2019ve snatched something from somebody\u2019s hand. You take a bullet for violence,\u201d she told Fox News Digital, which added:<\/p>\n<p><em>The witness said it was clear to her that Penny waited until the last minute to intervene for the sake of his fellow passengers.\u00a0<\/em><em>She heard a thump when he dragged Neely to the ground but couldn\u2019t see clearly until the doors opened at the Broadway-Lafayette station and most of the passengers exited.\u00a0<\/em><em>The witness waited for the police to arrive and provided a statement.<\/em><\/p>\n<p>\u201cMr. Penny cared for people. That\u2019s what he did. That is his crime,\u201d she told Fox News Digital, adding that she and some other passengers thanked Penny after the incident.<\/p>\n<p>She added that Penny seemed shaken up by the altercation after the fact.<\/p>\n<p>\u201cNobody wants to kill anybody. Mr. Penny didn\u2019t want to kill that man,\u201d she said. \u201cYou should have seen the way Mr. Penny looked. He was distraught. He was very, very, very visibly distressed. And he didn\u2019t go. He didn\u2019t run. He stayed.\u201d<\/p>\n<p>During Penny\u2019s arraignment, Prosecutor Joshua Steinglass stated that the Marine veteran, who has resided in the New York area his whole life, continued to restrain Neely for a \u201cperiod of time\u201d even after Neely had ceased any movement.<\/p>\n<p>Penny, however, remained on the train and went with NYPD officers to a nearby station to voluntarily answer questions. He was released afterward, but Bragg decided to prosecute days later.<\/p>\n<p>\u201cIt took three men to hold Mr. Neely down.
